Do not add a clause of discussion with unions on promotion, transfer and disciplinary action in IR code >>> Pradeep Tandon

Raipur, July 27, 2021 /// – Chairman of Chhattisgarh Committee of National Employers Federation Mr. Pradeep Tandon has asked the government not toprovide any clause in the IR Code that provides that matters relating to promotion, transfer or disciplinary procedure be discussed with the union.

In a press statement released here today Mr. Tandon said that there are certain rights of the Management. If aforesaid subjects made a part of the negotiation, then the very spirit of managing the business would be taken away which is a fundamental right of an employer. He was reacting to the draft IR Code being circulated by the Ministry of Labour, Govt. of India.

He said that draft rules also carry that a union with 30% membership be recognized for negotiation but it should be 51% as a minority of workers can’t force their negotiation on majority. Reacting to providing space to unions on the premises, he said that it would be provided to recognized unions and if there is more than one union, they have to share the same space.

आईआर कोड में प्रोन्नति, तबादले व अनुशासनिक कार्रवाई पर 

रायपुर, 27 जुलाई 2021 – नेशनल एम्प्लायर फेडरेशन की छत्तीसगढ़ कमेटी के चेयरमैन श्री प्रदीप टण्डन ने सरकार को आगाह किया है कि आईआर कोड, औद्योगिक संबंध संहिता में प्रोन्नति, तबादले व अनुशासनिक कार्रवाई जैसे मामलों पर मजदूर संघों से चर्चा की धारा न जोड़ी जाए।

यहां जारी एक प्रेस विज्ञप्ति में श्री टण्डन ने कहा कि प्रबंधन के अपने कुछ अधिकार भी होते हैं। यदि प्रोन्नति, तबादले और अनुशासनिक कार्रवाई जैसे मामलों में समझौता वार्ता की धारा जोड़ी गई तो यह व्यवसाय प्रबंधन की बुनियादी अवधारणा पर प्रहार होगा क्योंकि यह नियोक्ताओं का मौलिक अधिकार है। श्री टंडन आईआर कोड की प्रस्तावित इस नई धारा की प्रति केंद्रीय श्रम मंत्रालय द्वारा सार्वजनिक किये जाने पर प्रतिक्रिया व्यक्त कर रहे थे।

आईआर कोड की प्रस्तावित इस नई धारा के प्रावधानों पर प्रकाश डालते हुए श्री टण्डन ने कहा कि इसमें कुछ और खामियां भी हैं। एक प्रमुख खामी है कि यह प्रस्तावित धारा 30 प्रतिशत सदस्यता वाले मजदूर संघों को समझौता वार्ता के लिए अधिकृत करने की बात करती है जबकि होना यह चाहिए कि वे मजदूर संघ ही अधिकृत किये जाएं जिनकी सदस्य संख्या 51 प्रतिशत से अधिक हो क्योंकि अल्पमत वाले मजदूर संघ कैसे बहुमत वालों से अपनी बात मनवा सकते हैं? कारखाना परिसरों में मजदूर संघों को जगह उपलब्ध कराने के मामले में प्रतिक्रिया व्यक्त करते हुए उन्होंने कहा कि सिर्फ मान्यता प्राप्त संगठनों को यह सुविधा मिलनी चाहिए। अगर एक से अधिक मजदूर संघ हैं तो उन्हें आपस में मिलकर उस जगह का इस्तेमाल करना होगा।
